§ 3.02 THE VILLAGE CLERK.
   (A)   Appointment and term. The Village Clerk shall be appointed by the President with the advice and consent of the Board of Trustees and shall serve for a four-year term or the duration of the term of office of the Village President who appointed said Clerk, whichever is shorter. The Village Clerk shall take his or her oath of office before assuming his or her duties.
   (B)   Duties. The Village Clerk shall perform the following duties.
      (1)   He or she shall seal and attest all contracts, licenses, permits and such other instruments and documents of the village as are provided for by law or by ordinance.
      (2)   He or she shall turn over all money received on behalf of the village to the Village Treasurer promptly upon receipt of same, and shall furnish the Village Treasurer a statement as to the source thereof.
      (3)   He or she shall maintain accounts showing all funds received on behalf of the village, the source and disposition thereof and such other accounts as may be required by law or by ordinance.
      (4)   He or she shall keep a register of all licenses and permits issued, a record showing all of the officers and regular employees of the village and such other records as may be required by law or by ordinance.
      (5)   He or she shall be the custodian of all papers, instruments and documents belonging to the village which are not assigned for custody to another officer of the village or to the President or Village Board.
      (6)   He or she shall keep and maintain a proper index of all documents and records in his or her possession.
      (7)   He or she shall be the custodian of the village seal, and shall affix its impression upon all papers, instruments and documents as shall be required by law or by ordinance.
      (8)   He or she shall attend all meetings of the Village Board and shall accurately record the minutes of all such proceedings of the Village Board, and shall record and file in separate files all motions, resolutions, ordinances and other actions passed and approved by the Village Board.
      (9)   In addition, he or she shall perform such other duties as may be required by law or by ordinance.
   (C)   Deputy Clerk. The Village Clerk shall hereafter be authorized to appoint one Deputy Clerk to discharge the functions and duties of the Village Clerk. The Deputy Clerk need not be a resident of the Village of Lakemoor. The Deputy Clerk shall receive compensation of $150 per month. If the Deputy Clerk attends a meeting in the place of the Village Clerk, the Deputy Clerk shall receive the same compensation as the Village Clerk would have received if the Village Clerk had attended that meeting.
      (1)   The Deputy Clerk may execute all documents required by law to be executed by the Village Clerk and may affix the seal of the Clerk wherever required. In signing any document, the Deputy Clerk shall sign the name of the Clerk followed by the word “By” and the Deputy Clerk’s own name and the words “Deputy Clerk”.
      (2)   The powers and duties of the Deputy Clerk shall be exercised only in the absence of the Clerk from the place where the Clerk’s office is maintained and only when either written direction has been given by the Clerk to that Deputy to exercise a power or the corporate authorities have determined by resolution that the Village Clerk is temporarily or permanently incapacitated to perform that function.
      (3)   When the Deputy’s signature is duly authorized as provided in this section and is affixed by the Deputy in the manner prescribed in this section on any document (including, but not limited to, contracts, bonds or other obligations of the village) the document shall have the same effect as if the document had been signed by the Village Clerk in person.
   (D)   Bond. Before entering upon the duties of office, the Village Clerk and Deputy Clerk shall execute a bond in such amount and with such sureties as may be required by law or by ordinance, conditioned upon the faithful performance of the duties of the office. The village shall pay the premium on such bond.
