§ 53.06 ADDITIONAL CONDITIONS REQUIRING ASSESSMENT OF IMPACT FEES.
   In the event of a nonconforming structure that is damaged, and such damage exceeds 50% of the fair market value of such structure prior to receiving the damage, the village may, at its discretion and in addition to assessing applicable impact fees, require that the owner or applicant bring such rebuilt structure into conformity with all current codes of the village, or refuse to issue permits to reconstruct the damaged structure unless such applicant petitions for and receives the zoning relief necessary to allow such use. If any residential structure is expanded to add living space which, in square footage, exceeds 50% of the existing living space, the village shall assess one half of the then applicable impact fees to such owners. Such fees shall be paid prior to the issuance of building permits.
