§ 94.03 APPLICATION FOR SPECIAL EVENTS PERMIT.
   Any person seeking the issuance of a special events permit shall file an application with the Office of the City Clerk on forms provided by the city, except all government sponsored events shall be exempt from this requirement.
   (A)   Filing period. For single, non-recurring special events, an application for a permit shall be filed not less than 60 calendar days before the date and time at which it is proposed to commence; provided, however, that the city may waive the minimum 60 day filing period and accept an application filed within a shorter period if after due consideration of the date, time, place and nature of the assembly, the anticipated number of participants, and the city services which will be required in connection therewith, the affected departments determine that such waiver will not present a hazard to the public safety because of the reduced amount of time available within which to fully process the application. The application shall be signed by the applicant and the owner of the property where the event is to occur.
   (B)   Contents. The application for a permit shall set forth the following information, and such other information as may from time to time reasonably be required:
      (1)   The name and telephone number or other contact information of the person seeking to conduct the event.
      (2)   If the event is proposed to be conducted for, on behalf of, or by an organization, the name, address and telephone number of the headquarters of the organization and responsible heads of such organization.
      (3)   The name and telephone number of the individual person who will be the event contact person and the person responsible for the conduct of the event.
      (4)   The date when the event is to be conducted.
      (5)   The type of event, including a description of the activities which will occur during the event.
      (6)   The hours when such event will start and terminate.
      (7)   A description of any and all recording equipment, sound amplification equipment, or other attention-getting devices which will be utilized in connection with the event.
      (8)   The approximate number of participants, not including spectators, who will participate in the event.
      (9)   The approximate number of spectators who will be present at or near the event.
      (10)   The exact location of the event and if the event involves the use of streets, a list of the streets involved shall be provided.
      (11)   A designation of any public facilities or equipment proposed to be utilized.
      (12)   Any required site plans as may be deemed necessary by the city, including the plan for crowd control.
      (13)   If the applicant contends the event is a public issue speech event, the applicant must file an affidavit to that effect.
      (14)   Applicant shall abide by Chapter 155, Appendix I, Sign Code of the Lake Mary Code of Ordinances.
      (15)   Applicant will indicate whether alcohol will be sold or provided during the event.
      (16)   Applicant will be responsible for all clean up associated with the event or reimbursement cost to the city as determined by staff.
   (C)   Fees.
      (1)   A non-refundable fee, as established by resolution, to cover the administrative costs of processing the permit, shall be paid to the City of Lake Mary by the person applying for the permit at the time of filing of the application.
      (2)   If the application is for the use of any city property or if any city services required for the event, the applicant shall pay, prior to the issuance of the permit, the charges as determined by the affected department.
      (3)   The permit fee may be waived by the City Manager for a public issue speech event if the permit fee would be so financially burdensome that it would preclude the applicant from exercising First Amendment rights, and adequate alternate channels of expression are not available. Within five calendar days of a written request from the applicant to waive the fee, the City Manager shall render a written decision on whether the fee shall be waived and shall set forth the reasons for the decision.
   (D)   Notice to city officials. Immediately upon filing of the application for a permit, the City Clerk shall send a copy of the application to all departments for comment including:
      (1)   The Police Department/Code Enforcement.
      (2)   The Fire Department.
      (3)   The Director of Community Development.
      (4)   The Director of Public Works.
      (5)   The Director of Parks and Recreation.
