§ 160.05 DEVELOPMENT STANDARDS FOR WETLAND PROTECTION ZONES AND FOR LAND ADJACENT TO WETLAND PROTECTION ZONES.
   (A)   There is hereby created an Environmental Buffer Zone adjacent to each Wetland Protection Zone. This zone shall encompass all land within 25 feet landward of the boundary of the Wetland Protection Zone to include any part of the Special Flood Hazard Area that extends beyond the Wetland Protection Zone.
   (B)   The Wetland Protection Zone shall be dedicated as a conservation easement pursuant to F.S. Ch. 704.06 prior to the issuance of a certificate of occupancy for the primary structure.
   (C)   Development standards and minimum submittal requirements.
      (1)   The acreage within a Wetland Protection Zone may not be used to determine the total allowable units, density, or square footage of development that may be allowed on a site containing all or part of such zone.
      (2)   The following special design standards apply to Environmental Buffer Zones and land adjacent to Wetland Protection Zones:
         (a)   Minimum lot size shall be at least the minimum for the zoning district where the development is located, not to include land within the Wetland Protection Zone, unless the property is lot of records as defined in § 154.09 and further described in § 154.10(C).
         (b)   All commercial development must maintain a 200-foot setback from the Environmental Buffer Zone.
         (c)   The developer shall completely restore any portion of a Wetland Protection Zone or Environmental Buffer Zone damaged during construction. Complete restoration means that the damaged area shall, within two years, be operating as effectively as the natural system did prior to being damaged.
         (d)   The landward edge of the Environmental Buffer Zone should be flagged or otherwise noted as a no construction zone through signage installed by the developer.
         (e)   Turbidity barriers and silt screens shall be installed along the landward edge of the Environmental Buffer Zone prior to site construction. These barriers and screens shall be inspected by the City Engineer or designee after installation.
         (f)   Sanitary sewer systems should be used when developing property adjacent to the Wetland Protection Zone. If sanitary sewer is not available as defined in § 50.001, septic tanks may be used but must be at least 200 feet from the Wetland Protection Zone. If this setback is not possible in the opinion of the Administrative Official due to lot size outside of the WPZ or EBZ, a Department of Health approved aerobic treatment system shall be used.
         (g)   Other reasonable protective measures necessary to prevent significant adverse effects on the Wetland Protection Zone may be required by the city. Protective measures may include but are not limited to:
            1.    Maintaining natural drainage patterns;
            2.   Limiting the removal of vegetation to the minimum necessary to carry out the development activity;
            3.    Expeditiously replanting denatured areas;
            4.    Constructing channels at minimum depth and width necessary to achieve their intended purposes to prevent slumping and erosion and allow re-vegetation of banks;
            5.    Designing, locating, constructing and maintaining all development in a manner that minimizes environmental damage; and
            6.   Using deed restrictions, developer agreements and other legal mechanisms to require the developer and successors to protect the environmentally- sensitive areas and maintain the development in compliance with these protective measures.
            7.    Driveways shall meet the setback requirements of the main structures as defined by the zoning district of the parcel. This does not include the driveway apron.
      (3)   The following documents shall be submitted to the city when a developer applies for a land use approval for a property that is encumbered by a Wetland Protection Zone. Additional documentation may be requested by the city.
         (a)   Legal description of the property, and size of parcel in acres or square feet.
         (b)   Three signed and sealed copies of the development plan, drawn to a reasonable scale, prepared by a Florida-licensed land surveyor. This development plan must show the following information at a minimum:
            1.   Limits of the Wetland Protection Zone as defined by § 160.03.
            2.   Limits of 100-year floodplain, if applicable.
            3.    Topographic information delineated as one foot contour intervals.
            4.   Location of the proposed improvements, including setback dimensions from the Wetland Protection Zone, any flood plains, and property lines.
            5.   Tree survey showing the location of all trees on site which are a minimum of six inches in diameter measured approximately three feet above the ground designating the trees to be retained, removed, relocated, or replaced. Smaller trees to be retained may also be shown by the applicant to assist the Arbor Inspector in determining replacement requirements. Groups of trees in close proximity may be designated as “clumps” of trees with the estimated number and type of trees noted. Trees with a diameter of 24 inches and greater shall be identified by type, height, diameter and canopy spread. Trees to be removed, relocated, or replaced must be named (common or botanical name) on the plan. A general description of existing vegetation on the tract shall also be provided.
         (c)   Approval from the Seminole County Department of Health for location and design of septic tank, if applicable.
         (d)   A drainage plan which includes an engineering plan and specifications, in accordance with Appendix C of Chapter 155, for the collection and treatment of storm drainage, including a description of the preservation of any natural features, such as lakes and streams, or other natural features. The purpose of the drainage plan is to show how all drainage will be retained on site without impacting neighboring properties.
