§ 157.16 MINIMUM TREE STANDARDS.
   No certificate of occupancy shall be issued on the types of construction indicated below unless the underlying parcel has at least the required minimum number of approved trees:
   (A)   Any new one or two-family dwelling unit on a lot less than 6,000 square feet: not fewer than two canopy trees. Understory trees or palm trees can be utilized using the equivalency and planting standards outlined in § 157.17(F)(1).
   (B)   Any new one or two-family dwelling unit on a lot equal to 6,000 square feet: not fewer than two canopy trees plus one additional canopy tree for each 4,000 square feet over 6,000 square feet. Understory trees or palm trees can be utilized using the equivalency and planting standards outlined in § 157.07(F)(1).
   (C)   Any commercial, industrial, multi-family or other structure requiring site plan approval under the city land development regulations: for properties up to 1-1/2 acres, a minimum of six canopy trees will be required; for properties one and one-half acres or greater, four canopy trees per acre, whichever is greater will be required.
   (D)   In the event an applicant wishes to remove a historic tree from a construction site as part of a new commercial or industrial site plan, or residential subdivision, and the tree is not within an area of infrastructure, building pad, or within 7.5' of a building, all of the following mitigation must occur (no variance or waiver is permitted):
      (1)   Replacement canopy trees planted at a ratio of 5:1; and
      (2)   Replacement understory trees planted at a ratio of 7:1.
      (3)   In the event replacement trees are unable to be planted on site, a contribution to the City Tree Bank of $1,250 per historic tree removed shall be made.
