§ 2 PERMIT APPLICATION.
   (A)   Information required.
      (1)   Any person desiring a permit for the operation of a borrow pit or borrow area shall make written application to the city.
      (2)   The application shall include the following information:
         (a)   The name and address of applicant.
         (b)   The date of application.
         (c)   The name and address of any independent contractor to be utilized in hauling or transporting excavated materials.
         (d)   A general description and legal description of the project site.
         (e)   A brief explanation of the project.
         (f)   The date the work is planned to start.
         (g)   The anticipated length of time of the project.
         (h)   The hours of operation.
         (i)   The routes to be utilized in hauling or transporting excavated materials.
         (j)   The size of vehicles to be utilized in hauling or transporting excavated materials.
         (k)   The amount of excavated materials to be removed.
      (3)   In addition, the application shall be accompanied by the following:
         (a)   A complete survey and topographic map prepared by a surveyor registered in the state, indicating the extent of the work proposed.
         (b)   Proof of ownership as to all areas of land upon which it is to be operated.
         (c)   A proposed plan of reclamation of the property at the conclusion of the project.
   (B)   Fee. An application for a permit to operate a borrow pit shall be accompanied by such fee as is established by duly-adopted resolution of the City Commissioners.
   (C)   Hearing.
      (1)   Notice. Upon the receipt of an application for the operation of a borrow pit or borrow area requiring a public hearing, the city shall set a date for the required public hearing, and publish a notice of the hearing one time in a newspaper of general circulation in the county at least one week prior to the hearing, describing the work proposed, and a general and legal description of the location of the project. In addition, the Commission shall cause notices of the required public hearing to be sent to all property owners who, as determined by it, might be affected by the excavations, or the transporting or hauling of excavated materials therefrom.
      (2)   Conduct. At the required public hearing for a borrow pit or borrow area permit, the City Commissioners shall hear such testimony and presentation, and shall review such submittals, recommendations, and information, as shall be necessary to determine the effects of the proposed work on the rights and interests of the public. The Commission may require reports to be made as deemed necessary prior to the issuance of the borrow pit or borrow area permit.
