(A) Effluent generated from a source outside the city limits shall not be disposed of within the city limits by any public or private person without the written approval of the City Commission, or its designated agent. No such effluent shall be accepted unless the City Commission, upon recommendation by the city staff, determines that the supply of effluent generated within the city limits is sufficiently low as to warrant acceptance of effluent generated from outside the city limits.
(B) No permittee may accept effluent from a source outside the city limits for disposal upon permittee's property without first obtaining written verification from the city staff that the assimilative capacity of permittee's property cannot be satisfied by sources of effluent within the city limits. The City Commission shall make its determination based on the facts presented to it by city staff regarding the overall amount of effluent available within the city limits as a whole for irrigation and other purposes, the amount of effluent projected by city staff to be available in the future, and any other factors which the City Commission or city staff deems appropriate.
