Every building or structure or part thereof, having an area 5,000 square feet or more of gross floor area, and used for manufacturing, warehouse, food processing or wholesale distribution, retail sales, office, institution, service establishments, public buildings, restaurants, or other uses similarly involving the receipt or distribution by vehicles of materials or merchandise, shall have loading and unloading spaces provided in accordance with the following guidelines:

Hours of operation: Loading or unloading operations are prohibited between the hours of 9:00 p.m. and 7:00 a.m. Monday through Friday and between the hours of 9:00 p.m. and 9:00 a.m. on Saturday, Sunday and Holidays and when the site abuts an existing conforming residential use, unless specifically allowed by the Development Review Committee.
An applicant may request a waiver of the number of spaces or the dimensions or both, subject to providing the following information in the form of a "Loading Demand Statement" to the Development Review Committee as part of the development review package:
1. The typical size of the delivery trucks;
2. The average frequency of delivery trucks;
3. The normal hours of delivery;
4. The average general type of cargo delivered or picked up (or both, as applicable);
5. The route of ingress, egress, and on-site maneuvering for the delivery trucks;
6. Identification of any expected problems which may be encountered; and
7. Any other factors the applicant deems significant to the safe operation of the loading area.
The Development Review Committee may waive the requirements for the number and dimensions of loading/unloading zones if it determines that the applicant's Loading Demand Statement adequately demonstrates that an alternative proposed loading/unloading zone(s) will sufficiently service a site.
