(A) The utility who will install and be responsible for the actual maintenance of the street lighting, shall protect and save the city and the district harmless from any and all damages and loss arising from, out of, or by reason of the construction, operation or maintenance of the street lighting within the district.
(B) Each lot, tract or parcel benefited by the street lighting as constructed and installed under the direction of the district, shall become subject to special assessment and shall immediately be placed upon the assessment roll.
