§ 12.04.045 TEMPORARY CERTIFICATE OF OCCUPANCY.
   A.   A temporary certificate of occupancy may only be issued if the following conditions are met:
      1.   No substantial hazard will result from occupancy of any building or portion thereof before the same is completed; and
      2.   The applicant has posted a financial assurance or security with the city in a principal amount equal to the estimated cost of the required off-site and on-site improvements as determined by the Community Services Department. The financial assurance or security shall guarantee completion of the improvement work, and it shall also be approved as to form by the City Attorney prior to final acceptance by the city.
   B.   The temporary certificate of occupancy shall specify the date set for compliance with all applicable codes, but at no time shall the date set for compliance be more than 60 days from the date the temporary certificate of occupancy is issued.
   C.   The temporary certificate of occupancy shall automatically expire on the date set in the agreement for the completion of the improvements or 60 days from issuance, whichever occurs first.
