§ 10.08.180 SKATEBOARDS, SCOOTERS, AND SKATES UPON PUBLIC ROADWAYS AND SIDEWALKS.
   A.   Definitions:
      1.   SCOOTER. A device propelled by human power having a deck, at least two tandem wheels in contact with the ground, and a handlebar for steering without a motor.
      2.   SKATEBOARD. A device propelled by human power having a deck and at least two tandem wheels in contact with the ground.
      3.   SKATES. Devices worn on feet having wheels in contact with the ground and include roller skates and rollerblades.
   B.   Skateboards, scooters, and skates may be operated upon public roadways and sidewalks under the following conditions:
      1.   Shall obey the instructions of official traffic-control signals, signs, and other traffic direction devices.
      2.   Shall operate as close as practicable to the right hand curb, edge of the roadway, or edge of a designated bicycle path or lane.
      3.   Shall signal all turning movements.
      4.   Shall yield the right-of-way to all other users upon approaching a sidewalk, bicycle path, bicycle lane, or multi-use path in order to cross.
   C.   Skateboards, scooters, or skates may be operated upon public roadways and sidewalks within city parks subject to the following conditions:
      1.   Shall yield to pedestrians and any type of disability mobility device.
      2.   Shall give an audible signal before overtaking and passing any pedestrian.
   D.   No person shall operate skateboards, skates, or scooters:
      1.   On any public roadway consisting of a total of 4 or more marked traffic lanes or having an established speed limit greater than 35 miles per hour.
      2.   On any public property where such activity is posted as prohibited.
      3.   On any private property without permission.
      4.   Upon any public roadway or sidewalk on McCulloch Boulevard between Acoma Boulevard and Smoketree Avenue.
   E.   Persons under 16 years of age operating skateboards, scooters or skates on any public roadway or sidewalk shall at all times wear a protective helmet.
   F.   From dusk to dawn, all persons operating skateboards, scooters, or skates on any public roadway or sidewalk shall be equipped with and use:
      1.   A headlamp emitting a white light and visible from the front at a distance no less than 500 feet.
      2.   A rear red reflector visible when illuminated by a vehicle head lamp from a distance of not less than 300 feet or a rear red lamp visible from a distance of 500 feet.
   G.   A violation of this section shall be a civil offense punishable by a sanction as fixed by the Court of no more than $25.00 per violation.
