§ 8.24.040 APPLICATION.
   The following process shall be followed in the disposition of public owned property determined not necessary to promote a legitimate public purpose.
   A.   The applicant shall submit a letter of request to the Community Investment Department. The letter shall state at a minimum the legal description of the property to be purchased and intention of use. In addition, the ownership of all property owners within 300-feet of the subject parcel shall be provided as obtained from the Mohave County Assessor.
   B.   The Community Investment Department will convey a copy of the request and materials to the Public Works Department, Police Department, Fire Department, and the Administrative Services Department for review and comment on the need of the subject parcel for public purpose.
   C.   The applicant will be required to pay for the full cost of the appraisal and title report as obtained by the Community Investment Department before the appraisal and title report is initiated. Only the appraisal as coordinated through the Community Investment Department will be used for establishing an appraised value.
   D.   Upon completion of the appraisal and title report, staff shall set a closing date for submittal of bids and provide necessary notification and property posting in accordance with A.R.S. § 9-402. Property shall be sold to the highest bidder and the base bid will be the appraised value of the property and cost of staff processing time.
   E.   If the successful bidder is not the applicant who submitted the initial request, the successful bidder will reimburse the cost of the appraisal and title report to the applicant.
   F.   The Community Investment Department will notify property owners within 300-feet of the subject property via first class mail of the details of the pending bid process. The property owner list as provided by the applicant and obtained from the Mohave County Assessor will be used as the basis for the property owner mailings.
   G.   The City Council will hold a public hearing to accept the highest bid and to direct staff to transfer ownership of the property. The City Council holds the right to reject all bids.
   H.   The successful bidder shall be responsible for the preparation of documents necessary to convey title of the property. Documents are to be reviewed and approved by the Lake Havasu City Attorney’s Office prior to recording with Mohave County by the Community Investment Department.
   I.   The sale of public property shall be consistent with A.R.S. §§ 9-402 and 39-204.
