§ 153.078 PROHIBITED VARIANCES.
   A variance may not be granted for any of the circumstances cited below.
   (A)   Use variances. A variance shall not be granted for any use that is not allowed in the same floodplain or zoning district.
   (B)   Lower degree of flood protection prohibited. A variance may be used to modify permissible methods of flood protection; however, variances shall not be granted to permit a lower degree of flood protection than the RFPE.
