§ 155.08 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALLEY. A public or private right-of-way primarily designed to serve as secondary access to the side or rear of those properties whose principal frontage is on some other street.
   APPLICANT. The owner of land proposed to be subdivided or his or her representative. Consent shall be required from the local owner of the premises prior to subdividing the property.
   BLOCK. A tract of land bounded by streets, or by a combination of streets and public parks, cemeteries, railroad rights-of-way, shorelines of waterways or boundary lines of municipalities.
   CITY COUNCIL. The governing body of Lake Crystal, Minnesota, authorized by law to enforce this chapter.
   CITY ENGINEER. The engineer designated by the City Council to furnish engineering assistance for the administration of this chapter.
   CITY PLANNING COMMISSION. The planning review body of Lake Crystal, Minnesota, authorized by law to implement this chapter.
   CONCEPT PLAN. A sketch preparatory to the preparation of the preliminary plat to enable the subdivider to save time and expense in reaching general conclusions with the Planning Commission as to the form of the plat and objectives of this chapter.
   DESIGN STANDARDS. The specifications to landowners or subdividers for the preparation of plats, both preliminary and final, indicating among other things, the optimum, minimum or maximum dimensions of such items as rights-of-way, blocks, easements and lots.
   EASEMENT. A grant by a property owner for the use of a strip of land for the purpose of constructing and maintaining utilities, including, but not limited to, sanitary sewers, water mains, electric lines, telephone lines, storm sewer or storm drainageways and gas lines.
   LAND USE POLICY PLAN. The Lake Crystal, Minnesota land use policy plan. Maps, charts and information that form the basis for long-range planning for the city.
   PEDESTRIAN WAY. A public or private right-of-way across a block or within a block providing access for pedestrians and which may be used for the installation of utilities.
   PLAT. The drawing or map of a subdivision prepared for filing of record pursuant to M.S. Ch. 505, as it may be amended from time to time, and containing all elements and requirements of this chapter.
      (1)   PRELIMINARY PLAT. The map, drawing or chart indicating the proposed layout of the subdivision to be submitted to the Planning Commission for its consideration.
      (2)   FINAL PLAT. A drawing or map of a subdivision, meeting all the requirements of the city and in such form as required by this chapter for purposes of recording.
   STREET. A public right-of-way affording primary access by pedestrians and vehicles to abutting properties, whether designated as a street, highway, thoroughfare, parkway, throughway, road, avenue, boulevard, land, place or however otherwise designated.
   STREET, CUL-DE-SAC. A minor street with only one outlet and having an appropriate terminal for the safe and convenient reversal of traffic movement.
   STREET RIGHT-OF-WAY. The shortest distance between lines of lots delineating the street.
   SUBDIVIDER/OWNER. Any person who: having an interest in land, causes it, directly or indirectly, to be divided into a subdivision; or who directly or indirectly, sells, leases or develops, or offers to sell, lease or develop, or advertises for sale, lease or development, any interest, lot, parcel site, unit or plat in a subdivision; or who engages directly or through an agent in the business of selling, leasing, developing or offering for sale, lease or development a subdivision or any interest, lot, parcel site, unit or plat in a subdivision; and who is directly or indirectly controlled by, or under direct, or indirect common control with any of the foregoing.
   SUBDIVISION. The separation of an area, parcel or tract of land under single ownership into two or more parcels, tracts, lots or long-term leasehold interests where the creation of the leasehold interest necessitates the creation of streets, roads or alleys, for residential, commercial, industrial or other use or any combination thereof, except those separations:
      (1)   Where all the resulting parcels, tracts, lots or interests will be 20 acres or larger in size and 500 feet in width for residential uses and five acres or larger in size and 300 feet in width for commercial and industrial uses;
      (2)   Creating cemetery lots; or
      (3)   Resulting from court orders, or the adjustment of a lot line by the relocation of a common boundary.
   SURVEYOR. A land surveyor properly licensed and registered in the State of Minnesota.
