(A) Established. The Lake Superior Court, County Division III Alcohol and Drug Program/ Monitoring Fee Fund is hereby established for the deposit of all fees collected pursuant to I.C. 12-23-14-16, for the court’s alcohol and drug services program.
(B) Fee collections. A fee of $100 per defendant shall be collected at the time of sentencing and referral to an alcohol and drug program.
(C) Appropriations of funds. Pursuant to I.C. 36-2-5-2(b), the County Council shall appropriate all money to be paid out of the Fund, except as otherwise provided by law.
(D) Non-Reverting fund. Any money remaining in the Fund at the end of the year shall not revert to any other fund but continues in the Lake Superior Court, County Division III Alcohol and Drug Program/Monitoring Fee Fund.
