(A) Transporters, shippers, and receivers of hazardous materials may apply to the Director of the Civil Defense of Lake County for an exception to the requirements of this subchapter. An exception will be granted only where the following criteria are met:
(1) Compelling need. The applicant must show a compelling need that delivery or pickup of the hazardous material can be made only by entering incorporated areas.
(2) Public interest. Transportation of the hazardous material in violation of the restrictions of this subchapter is in the public interest.
(B) An application for an exception under this section shall be filed with the permit section of the Civil Defense Department of Lake County.
