§ 73.002 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply.
   AIRBOAT. Any boat (but not including airplanes or hydroplanes) propelled by machinery applying force against the air rather than the water as a means of propulsion.
   COMPETENT. Capable of assisting a skier in case of injury or accident.
   COUNTY. Lake County, State of Illinois.
   DEPARTMENT. The Illinois Department of Natural Resources.
   HOLDING TANK. A permanently installed container which receives the discharge from one toilet or more and retains the sewage for on-shore disposal.
   LIFEBOAT. A small boat kept on board a larger boat for use in emergency.
   LOCAL AUTHORITY. Every county, municipal, and other local board or body having the authority to adopt local police regulations under the Constitution and laws of this state.
   MARINE TOILET. Any toilet on or within any watercraft.
   MOTORBOAT. Any vessel propelled by machinery, whether or not the machinery is the principal source of propulsion, but does not include a vessel which has a valid marine document issued by the Bureau of Customs of the United States government, or any federal agency or successor thereto.
   OPERATE. To navigate or otherwise use a motorboat or vessel.
   OTHER WASTES. Garbage, wood, petrochemical and chemical products, and animal or vegetable material.
   OWNER.
      (1)   A person, other than lien holder, having title to a motorboat.
      (2)   The term includes a person entitled to use or possession of a motorboat subject to an interest in another person, reserved or created by agreement, and securing payment of performance of an obligation, but the term excludes a lessee under a lease not intended as security.
   PERSON. An individual, partnership, firm, corporation, association, or other entity.
   PERSONAL FLOATATION DEVICE or PFD. A device that is approved by the Commandant, U.S. Coast Guard, under C.F.R. part 160.
   PERSONAL WATERCRAFT. A vessel that uses an inboard motor powering a water jet pump as its primary source of motor power and that is designed to be operated by a person sitting, standing, or kneeling on the vessel, rather than the conventional manner of sitting or standing inside the vessel, and includes vessels that are similar in appearance and operation but are powered by an outboard or propeller drive motor.
   PORTABLE TOILET. A self-contained unit with a provision for retaining sewage in a holding tank for disposal to a sewage system acceptable to the county.
   RECIRCULATING TOILET. A holding tank with all necessary devices to provide for the recirculation of flushing liquid and for the receiving, venting, and shore removal of sewage.
   SAILBOAT. Any watercraft propelled by sail or canvas. For the purposes of this chapter, any watercraft propelled by both sail or canvas and machinery of any sort shall be deemed a motorboat when being so propelled.
   SEWAGE. Water-carried human and related wastes.
   SPECIALTY PROP-CRAFT. A vessel that is similar in appearance and operation to a personal watercraft but that is powered by an outboard or propeller driven motor.
   UNDER WAY. Applies to a vessel or watercraft at all times except when it is moored at a dock or anchorage area.
   USE. Applies to all vessels on the waters of this county, whether moored or underway.
   VESSEL or WATERCRAFT. Every description of watercraft other than a seaplane on the water used or capable of being used as a means of transportation on water.
   WAKE. A movement of the water created by a boat under way enough to disturb a boat at rest, but under no circumstances shall a boat exceed five miles per hour while in a posted “No Wake” area. “No Wake” areas shall be clearly posted with buoys or appropriate signs. All buoys or signs posting the “No Wake” areas shall meet the specifications as prescribed by the U.S. Coast Guard or the Illinois Department of Natural Resources.
   WASTEWATER. Sewage, industrial waste, or other waste, or any combination.
   WATERCRAFT. Any vessel manufactured or used primarily for non-commercial use or leased, rented, or chartered to another for non-commercial use, or any vessel used for livery or other commercial use, unless otherwise stipulated in a particular subchapter of this chapter.
   WATERS OF THE COUNTY. Any water within the jurisdiction of Lake County, State of Illinois.
