§ 31.017 ZONING BOARD OF APPEALS.
   (A)   Creation and membership. A Zoning Board of Appeals, hereafter referred to by the term “Zoning Board”, is hereby authorized to be established. Such Zoning Board shall consist of seven members appointed by a Chair and confirmed by the members of the County Board. As terms expire, each appointment shall be for five years. Vacancies shall be filled by the Chair of the County Board for the unexpired terms only, subject to confirmation by the County Board at its next meeting. The Chair of the County Board shall have power to remove any member of the Zoning Board, for cause, after a public hearing upon giving ten days’ written notice.
   (B)   Chairman and meetings.
      (1)   The Chair of the County Board shall name one of the members of the Zoning Board as Chair upon his appointment and, in case of vacancy, shall name the Chair. All meetings of the Zoning Board shall be held at the call of the Chair or any three members of the Zoning Board, at such times and places within the county as the Zoning Board may determine. Such Chair or, in his absence, the acting Chair may administer oaths and compel the attendance of witnesses. All meetings of the Zoning Board shall be open to the public.
      (2)   The Zoning Board shall keep minutes of its proceedings showing the vote of each member upon every question or, if absent or failing to vote, indicating such fact, and regulation, every amendment or repeal thereof, and every order, requirement, decision or determination of the Zoning Board shall immediately be filed in the office of the Zoning Board located in the office of the Department of Planning, Building, and Development and shall be a public record. In the performance of its duties, the Zoning Board may incur such expenditures as shall be authorized by the County Board. The Zoning Board shall adopt its own rules of procedure not in conflict with the statute of this section.
   (C)   Bylaws. The Zoning Board of Appeals shall maintain bylaws regulating its operation in accordance with the bylaws as approved by the County Board at the creation of the Zoning Board of Appeals. The bylaws may only be amended upon an affirmative vote of five members of the Zoning Board of Appeals.
