§ 54.06 VARIANCE.
   (A)   Variances from the regulatory standards of this chapter may be granted in accordance with the requirements provided below. Any application for a variance shall be made to, and decided by, the Engineering Supervisor.
   (B)   Submit a letter addressed to the Engineering Supervisor of Public Works. Indicate:
      (1)   The desire for the variance.
      (2)   Cite the section herein.
      (3)   List the reason for the variance.
   (C)   The Department shall grant or deny the variance request if the Engineering Supervisor finds that the following criteria are met:
      (1)   There are exceptional or extraordinary circumstances applicable to the subject request that do not apply to similar properties, projects or requests.
      (2)   There will be no additional threat to public health, safety, or welfare or the creation of a nuisance.
      (3)   No additional public expense will result.
      (4)   Cost to the applicant of strict compliance with this chapter is not the primary reason for granting the variance.
