(A) It is the policy of Lake County to encourage travel by pedestrian and bicycle facilities. Pedestrian and bicycle facilities should be integral to the transportation facilities of adjacent neighborhoods and development with access across the county highway rights-of-way at acceptable locations as determined by the LCDOT.
(B) Bicycle and pedestrian facilities to be constructed along a county highway may be located in easements outside of the right-of-way of the county highway or may be located within the right-of-way if the local agency accepts maintenance responsibility for the facility and sufficient area exists to meet appropriate design standards. The county reserves the right to reject requests for permitting of bicycle and pedestrian facilities where insufficient area exists or where installation of such facilities would create a potential for unsafe conditions.
(C) Bicycle and pedestrian facilities permitted under this chapter shall not be maintained by the county. The permittee for such facilities must be a municipal or local agency with sufficient financial and operational resources to properly maintain and operate said facilities in a manner satisfactory to the county.
