8-2-3-5: STORMWATER UTILITY FEE:
A.   Fee imposed. A stormwater utility fee is hereby imposed on the owner of property in the Village. The stormwater utility fee consists of the sum of the following:
   1.   Base fee. The base fee is the amount to be charged each month pursuant to the formula set forth in section 8-2-20.B of this Code in order to produce the amount of principal and interest on any outstanding stormwater system debt that is due and payable during the fiscal year for which the base fee is calculated.
   2.   Other fees. Such other rates, fees and charges that the Village Board of Trustees determines are necessary to recover certain costs related to operating, maintaining, and improving the stormwater system as set forth in the annual fee ordinance.
B.   Fee formula. The base fee for all parcels in the Village will determined by the zoning district of the parcel. The Village has determined the average amount of ERUs on properties based on a sampling of properties in each residential zoning district. Each parcel in a residential zoning district will have its number of ERUs be equal to that of the average of sampled parcels in its zoning district, rounded to the nearest 1/100 of an ERU. Each property in the CBD, O&R, AP-1, L-1, L-2, S, R, and RIO districts will equal the measured number of ERUs on the parcel, rounded to the nearest 1/100 of an ERU. The formula is illustrated as follows:
   Parcel Fee = (ERU x Current Rate $)
   For premises comprised of multiple parcels with multiple Property Index Numbers (PINs), the fee will equal the sum of the parcel fee for each parcel.
C.   Exception. Parcels with an ERU of less than 0.10 or less than 320 square feet of impervious area. (Ord. 2023-12, 4-25-2023)
