11-2-6: EXEMPTIONS:
A.   Parcels Less Than One Acre: An owner desiring to divide a lot or parcel of land of less than one acre into not more than two (2) parcels for purpose of sale or exchange, in any recorded subdivision which does not involve any streets or easements or access, may submit application to divide for consideration of the village board, provided:
1.   The division of the lot or parcel does not create a lot or parcel smaller in area than is required by the Lake Bluff zoning ordinance.
2.   The division of the lot or parcel does not create a nonconforming condition under village ordinances, including, but not limited to, existing building setbacks, side yards, rear yards and percent of lot or parcel occupied by buildings.
3.   A correct survey by a professional land surveyor is submitted, showing dimensions and square footage of lots or parcels to be created, and location of existing buildings, if any, on the lots or parcels. (Ord., 4-11-1978)
B.   Contiguous Parcels: The sale or exchange of parcels of land between owners of adjoining and contiguous land, with the approval of the village board, is exempt from the provisions of this title, provided: (Ord., 4-11-1978; amd. 2009 Code)
1.   The sale or exchange does not create additional lots or reduce any lot to an area smaller than required by the Lake Bluff zoning ordinance.
2.   The sale or exchange of the parcel does not create a nonconforming condition under village ordinances, including, but not limited to, existing building setbacks, side yards, rear yards and percent of lot or parcel occupied by buildings.
3.   A correct survey by a professional surveyor is submitted showing dimensions and new square footage of said lots or parcels involved and location of existing buildings, if any, on said lots and parcels.
C.   Parcels Less Than Five Acres With Improvements:
1.   Whenever owner(s) proposes a subdivision of a tract of land of less than five (5) acres, and public improvements such as streets, utilities and storm drainage have previously been installed, and such tract is to be divided into lots fronting on such street, the plan commission may authorize the submission of a sketch plat. A sketch plat is intended to allow the subdivider to informally discuss the subdividing of a less complicated subdivision.
2.   The sketch plat, as a minimum, must show the location of the proposed subdivision in relation to the surrounding area and existing manmade features such as railroads, streets, highways, alleys, drainage ditches and existing buildings. Proposed lots shall be platted with dimensions and square footage shown. Additionally, natural features such as lakes, creeks and topography should be shown.
3.   The sketch plat, when authorized, must be submitted to the plan commission in eleven (11) copies. The plan commission may, at their discretion, require the subdivider to provide copies of the sketch plats to the village board, school district and park district for comment.
4.   If the developer decides to further pursue subdivision, a tentative plat must be submitted for approval of the plan commission and village board in conformance with this title. However, the requirements for submitting plans and specifications for public improvements can be waived by the plan commission and village board, provided such facilities are deemed adequate. D.   Parcels Outside Village Limits: The village board may, by resolution duly adopted, waive any substantive or procedural requirement of this title as it applies to any subdivision or resubdivision located, in whole or in part, outside of the corporate limits of the village. (Ord. 94-8, 3-28-1994)
