9-17-6: EXCEPTIONS:
A.   Exceptional Project Circumstances: Applicants seeking a partial or complete exception granting relief from the requirements of this chapter must file with the department an application on a form provided by the department. The application must include, in addition to such other information as the department may require, a statement from a licensed professional engineer certifying that compliance with this chapter is impracticable due to exceptional or extraordinary circumstances or conditions applicable to the project. The code official may grant the exception only if the code official in his or her sole determination finds all of the following:
1.   There are exceptional or extraordinary circumstances or conditions applicable to the project that do not apply generally to similar projects and that make compliance with this chapter impracticable;
2.   Granting the exception will not constitute a grant of special privilege inconsistent with limitations imposed on similar projects which are subject to this chapter; and
3.   Cost to the applicant of strict compliance with this chapter is not the primary reason for granting the exception.
B.   Cost Based Exception: If a contractor receives a minimum of two (2) quotes for a recycling option and a garbage option and the recycling option is in excess of ten percent (10%) of the garbage option the contractor will be exempted from this chapter. (Ord. 2014-7, 4-28-2014)
