9-13-4: PREBUILDING PERMIT APPLICATION INQUIRY:
Prior to the submittal of detailed design drawings as part of a formal building permit application, an applicant may, at its option, submit to the building commissioner a site plan, a floor plan, and all exterior elevations of the proposed construction for the purpose of determining compliance with the requirements of this chapter. In the event that the building commissioner determines that the proposed construction will not produce one or more of the harmful effects listed in this chapter, the issuance of the building permit shall not be withheld by the building commissioner on the basis of any provision in this chapter; provided, however, that any three (3), but not less than three (3), members of the board of trustees may overrule the determination of the building commissioner and require that the building permit application, when formally submitted, be referred to the architectural board of review for a formal review pursuant to this chapter.
