5-1-2: CHIEF OF POLICE AND DEPUTY CHIEF OF POLICE:
A.   Chief Of Police:
1.   Bond: The chief of police shall execute, acknowledge and deliver to the village treasurer a bond in the penal sum of one thousand dollars ($1,000.00), in the usual form, or as is or shall hereafter be provided by law, with good and sufficient surety to be approved by the village board of trustees, and the cost of the premium of said bond to be borne by the village, said bond conditioned on the faithful performance of his official duties.
2.   Oath: The chief of police shall also take the customary oath of office before entering upon the duties of such office.
3.   Powers And Duties: The chief of police shall:
a.   Be the commanding officer of all sworn police officers and civilian personnel employed by the village in the police department. The chief of police shall perform such duties as are imposed upon him by law or ordinance and, in addition thereto, such other duties as may be assigned to him by the village administrator. He shall, under the supervision of the village administrator, pursuant to guidance from the village board of trustees, have full management and control of the police department, and all regulations and orders of the police department shall be promulgated through him. The chief of police shall see that all members of the police department are prompt and faithful in the discharge of their duties and that they take such measures as may be deemed expedient for the preservation of peace and good order and the enforcement of the laws and ordinances of the village.
b.   Cause the public peace to be preserved and to see that the laws and ordinances are enforced, and whenever any violation thereof shall come to his knowledge, or be reported to him, he shall attend to the prosecution of the offender.
c.   Be the custodian of all property provided for the use of the police department and shall also be the custodian of all stolen goods or other property received and retained by police authority.
d.   Be the keeper of the village public safety building and its jail and shall have the custody of all persons incarcerated therein.
e.   Report to the village attorney all breaches of the village ordinances as in his judgment require village attorney attention, and shall aid the attorney in the prosecution thereof.
f.   Pay to the proper custodian thereof, all monies collected by him within two (2) days after receiving the same.
g.   Report in writing to the village administrator at the beginning of each month, the activities of the police department, and such other information he deems necessary or appropriate, and such other information requested by the village administrator.
B.   Deputy Chief Of Police:
1.   Oath: The deputy chief of police shall take the customary oath of office before entering upon the duties of such office.
2.   Powers And Duties: The deputy chief of police shall:
a.   Have those powers, duties, and responsibilities as established by the chief of police in consultation with the village administrator, pursuant to the rules and regulations of the police department.
b.   Have, in the absence of the chief of police, all of the powers, duties, and responsibilities of the chief of police as authorized by state statute and this code.
C.   Residency: All newly appointed chiefs of police and deputy chiefs of police of the village shall reside within the village within twelve (12) months after the date of their appointment unless otherwise authorized by the board of trustees. (Ord. 2014-4, 2-24-2014)
