3-2-1: DEFINITIONS:
Unless the context otherwise requires, the following terms, as used in this chapter, shall be construed according to the definitions given below:
ALCOHOLIC LIQUOR: Includes alcohol, spirits, wine, beer and every liquid or solid, patented or not, containing alcohol, spirits, wine or beer and capable of being consumed as a beverage by a human being. The provisions of this chapter shall not apply to any liquid or solid containing one-half of one percent (0.5%) of alcohol by volume or less, or to liquids or solids containing in excess of one-half of one percent (0.5%) of alcohol by volume if dispensed by a licensed pharmacy pursuant to a medical prescription.
BAR SERVICE AREA: Any public place, ancillary and accessory to, and within the same building as, a restaurant, that is kept, used, maintained, advertised and held out to the public to be a place within which alcoholic liquor is intended to be consumed. For purposes of this chapter, "bar service area" shall include all areas intended to be devoted to the storage, preparation, sale, service and consumption of alcoholic liquor.
BEER: A beverage obtained by the alcoholic fermentation of an infusion or concoction of barley or other grain, malt or hops in water and includes, among other things, beer, ale, stout, lager beer, porter and the like.
BREWPUB: Premises that are subject to and maintain a valid brewpub license from the state of Illinois pursuant to section 5/5-1(n) of the Illinois liquor control act, 235 Illinois Compiled Statutes 5/5-1(n), as may be amended from time to time, and that contain facilities used for the manufacture of beer for the purposes of: a) making sales to importing distributors, distributors, and to nonlicensees for use and consumption only; b) storing beer manufactured at the premises, and c) conducting retail sales at the premises of beer manufactured at the premises or another designated location.
CATERING ESTABLISHMENT: A business conducted by a person, firm, or corporation for the purpose of providing food and service for a banquet or dinner which may occur in a location other than premises leased, owned, and/or operated by the catering establishment; the recipients of such food and/or service being persons specially invited to such banquet or dinner rather than members of the general public.
GROCERY STORE: Every building or other structure kept, used, maintained, advertised, and held out to the public to be a retail store that primarily conducts the retail sale of food and food items and the incidental retail sale of other nonfood items.
IDENTIFICATION CARD: A written, printed or photostatic document issued by a public officer of a federal, state, county or municipal government, or subdivision or agency thereof, in the performance of his or her official duties and evidencing the age and identity of a person, including, without limitation, a motor vehicle operator's license, a registration certificate issued under the federal selective service act, or an identification card issued to a member of the armed forces.
KNOWINGLY: Having general knowledge of, or reason to know, or a belief or ground for belief which warrants further inquiry or inspection.
LEGAL AGE: The minimum age designated by law of a person to whom it is lawful to sell, give or deliver a particular type of alcoholic liquor.
LEGAL GUARDIAN: A person appointed guardian, or given custody, of a minor by a circuit court of this state, but does not include a person appointed guardian or given custody of a minor under the juvenile court act of 1987, 705 Illinois Compiled Statutes 405/1-1 et seq.
LICENSEE: Any person, firm or corporation or partnership or club holding a license under the provisions of this chapter.
MINOR: A person under the age of twenty one (21) years.
ORIGINAL PACKAGE: Any bottle, flask, jug, can, cask, barrel, keg, hogshead or other receptacle or container, whatsoever used, corked or capped, sealed and labeled by the manufacturer of alcoholic liquor, to contain and to convey any alcoholic liquor.
OUTDOOR SERVICE AREA: Any outdoor location that is adjacent and accessory to a grocery store, restaurant or brewpub that is kept, used, maintained, advertised and held out to the public as a place within which alcoholic liquor may be sold and consumed.
PARENT: A natural or adoptive parent or a court designated guardian.
PRIVATE CLUB: A corporation organized under the laws of this state, operated for recreational and social purposes on a private membership basis, which may include the service of food and alcoholic liquor.
RESTAURANT: Any public place kept, used, maintained, advertised and held out to the public to be a place where meals are served, and where meals are actually and regularly served, without sleeping accommodations, such space being provided with adequate and sanitary kitchen and dining room equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook and serve suitable food for its guests. For purposes of this chapter, "restaurant" shall include all screened in or otherwise enclosed areas and rooms of such public place.
RETAIL SALE: The sale for use or consumption and not for resale.
SALE: Any transfer, exchange or barter in any manner or by any means whatsoever and includes all sales made by any person, whether principal, proprietor, agent, servant or employee.
TO SELL: Includes to keep or expose for sale and to keep with intent to sell.
UNEMANCIPATED MINOR: A minor still under the care and custody of at least one of his or her parents or a legal guardian.
VEHICLE OR PREMISES: Any privately owned and operated motor vehicle, conveyance or vessel; any house or apartment; any hotel, motel or bed and breakfast room, or any similar premises to which the general public is not normally admitted.
WINE: Any alcoholic beverage obtained by the fermentation of the natural contents of fruits or vegetables containing sugar, including such beverages when fortified by the addition of "alcoholic liquor" as defined in this section.
