1-12-4: PAYMENT OF FEES, CHARGES AND RATES:
A.   Payment Period: All fees, service charges, charges, rates or similar impositions (collectively referred to as "fees") required to be paid pursuant to this Code shall be fully paid and satisfied within thirty (30) days after the Village request for payment is made by invoice or otherwise. In the event that a shorter or longer payment period is expressly stated in this Code or otherwise established by the Village with respect to a specific fee, such shorter or longer payment period shall govern for that specific fee.
B.   Failure To Pay: The failure to pay any fee within the applicable time period for payment shall:
1.   Constitute an offense by the party applying for the service, permit or matter for which the fee is imposed; and
2.   Constitute an offense by the user of the service, permit or matter for which the fee is imposed; and
3.   Constitute a lien on the real property, if any, to or upon which the service, permit or matter is applied or used; provided, however, that:
a.   The Village Administrator shall file, or cause to be filed, a notice of such lien in the Office of the County Recorder of Deeds, or Registrar of Titles if the property is registered under the Torrens system, which notice shall consist of a sworn statement setting out:
(1)   A legal or other description of the property sufficient for the identification thereof;
(2)   The amount of the money due;
(3)   The date when such amount became due;
(4)   Notice that costs of collection, including attorney fees, will be added to the unpaid amount; and
b.   No less than ten (10) days prior to the filing of the notice of lien, the Village Administrator shall mail, or cause to be mailed, by certified mail, return receipt requested, a copy of the notice of lien to the current or last known owner of the property.
c.   Any lien filed pursuant to this section may be foreclosed in the manner provided by statute for mortgages or mechanics' liens. (2009 Code)
