11-1-12: PLANTS OVERHANGING PUBLIC PLACES; ROOTS IMPEDING DRAINAGE:
   A.   Any tree or shrub which overhangs any sidewalk, street or other public place in the Village in such a way as to impede or interfere with traffic or travel on such public place shall be trimmed by the owner of the abutting premises so that the obstruction shall be removed. Roots of any tree or shrub which impede drainage shall be removed by the owner of the abutting premises pursuant to a permit obtained from the Village for said work as provided in section 11-1-7 of this chapter.
   B.   Any limb of a tree which has become likely to or does fall on or across any public way or place shall be removed by the owner of the abutting premises pursuant to a permit obtained from the Village for said work as provided in section 11-1-7 of this chapter.
   C.   If the owner of the abutting premises fails to fulfill said responsibilities as specified above, the Village may fulfill said responsibilities, but shall not be required to do so. Removal by the Village of any such obstruction located on property not owned by the Village shall be performed at the property owner's sole cost and expense, and any costs therefor incurred by the Village shall constitute a debt due and owing to the Village by the property owner and shall promptly be reimbursed to the Village by the property owner, or the Village may record a lien against the respective property for any such costs incurred therefor by the Village.
