9-3-6: VACATION OF PLATS AND STREETS:
   A.   Referral Of Application: If an application for vacation of any subdivision, street, alley or public place, or part thereof, is made to the board of trustees, such application shall be referred to the plan commission and to the village engineer. Both the plan commission and village engineer shall make investigations and file written reports with the board of trustees.
   B.   Vacation Of Subdivision: If an application is made to the board of trustees to vacate a subdivision (in whole or in part) prior to the sale of any lot, the board of trustees may, by ordinance, order the vacation of all or a part of the said subdivision. If lots have been sold, the plat may be vacated, providing all the owners in said plat provide written concurrence.
   C.   Vacation Of Street, Alley Or Public Place: If an application is made to the board of trustees to vacate a street, alley or public place (or part thereof) within the village, the board of trustees may approve the application, but vacation orders require an affirmative vote of at least two-thirds (2/3) of the members of the board of trustees. In such cases, the owner or owners of property abutting on the street, alley or public place (or part thereof) shall pay compensation to the village in an amount judged by the board of trustees to be equal to the benefits which will accrue to the owners of such abutting property by reason of the vacation.
