8-6-4: CERTIFICATE OF LEGAL NONCONFORMANCE USES:
A certificate of legal nonconformance shall be required of all lawful nonconforming buildings, structures, or uses created by the adoption of this title or amendments.
Upon notification by the enforcement officer or designated representative, an application for a certificate of legal nonconformance for a nonconforming building or use shall be filed with the enforcement officer by the owner or lessee of the nonconforming building, structure or use. Provided the application is for a lawful nonconforming use, the enforcement officer shall issue such certificate of legal nonconformance within fifteen (15) working days of completion and filing of such application.
Failure to apply for a certificate of legal nonconformance for a nonconforming building, structure or use following such notification by the enforcement officer or designated representative shall be evidence that such nonconforming building, structure or use was either illegal or did not lawfully exist on the effective date of the ordinance codified in this chapter.
