7-5-1: APPLICABILITY:
The provisions of this chapter and its sections shall be applicable to the following types of construction projects that are required to obtain any permit, special use permit, variation, rezoning, under the provisions of this code, including under the provisions of the village of Lake Barrington zoning ordinance:
   A.   Multi-family dwellings, either newly constructed or as part of the rehabilitation or remodeling of an existing structure where the valuation for building permit fee purposes under this chapter exceeds fifty percent (50%) of the building's value prior to said remodeling or rehabilitation.
   B.   Commercial buildings that are:
      1.   Newly constructed or as part of the rehabilitation or remodeling of an existing structure where the valuation for building permit fee purposes under this chapter exceeds fifty percent (50%) of the building's value prior to said remodeling or rehabilitation; and
      2.   Located in the M, B or O zoning districts, as defined in the village of Lake Barrington zoning ordinance, title 8 of this code, as amended.
   C.   The provisions of this chapter shall not apply to a construction project with fifteen percent (15%) or more affordable housing units included in the project, as proposed. (Ord. 2011-O-07, 4-6-2011)
