4-1-3-7: CURFEW:
   A.   Age And Hour Restrictions Generally: It is unlawful for any person within the corporate boundaries of the village who is less than seventeen (17) years of age to be present at or upon any public assembly, building, place, street, or highway at the following times unless the person is: 1) accompanied by the child's parent or guardian; 2) accompanied by a person at least eighteen (18) years of age with the written approval by the child's parent or guardian; 3) participating in, going to, or returning by the most direct route from: a) lawful employment, occupation which the laws of the state authorize a person less than seventeen (17) years of age to perform, b) an activity sanctioned by his or her school, c) a religious event, d) an emergency involving the protection of a person or property from an imminent threat of serious bodily injury or substantial damage, e) an activity involving the exercise of the child's rights protected under the first amendment to the United States constitution or the constitution of the state of Illinois, or both, such as freedom of speech and the right of assembly, or f) an activity conducted by a nonprofit or governmental entity that provides recreation, education, training, or other care under the supervision of one or more adults; or 4) engaged in interstate or international travel from a location outside Illinois to another location outside Illinois:
      1.   Between one minute after twelve o'clock (12:01) A.M. and six o'clock (6:00) A.M., Saturday;
      2.   Between one minute after twelve o'clock (12:01) A.M. and six o'clock (6:00) A.M., Sunday; and
      3.   Between eleven o'clock (11:00) P.M. Sunday to Thursday, inclusive, and six o'clock (6:00) A.M. the following day.
   B.   School Hours:
      1.   Prohibition: It is unlawful for any person under the age of eighteen (18) who is enrolled in any public, private or parochial elementary or secondary school to be present in or upon any public place, street, building, or assembly, other than school, during any hours when his or her school is in session during the regular school term, unless he or she is:
         a.   Traveling to or from school by the most direct route; or
         b.   Engaged in an activity sanctioned by his or her school; or
         c.   Engaged in personal business, including, but not limited to, employment, medical care, educational and/or religious activities, with prior notice to school authorities from a parent or legal guardian; or
         d.   Participating in, going to, or returning by the most direct route from: 1) an activity sanctioned by his or her school, 2) a religious event, 3) an emergency involving the protection of a person or property from an imminent threat of serious bodily injury or substantial damage, 4) an activity involving the exercise of the child's rights protected under the first amendment to the United States constitution or the constitution of the state of Illinois, or both, such as freedom of speech and the right of assembly; or
         e.   Engaged in interstate or international travel from a location outside Illinois to another location outside Illinois.
      2.   Penalties:
         a.   If a person between the age of ten (10) years old and the age of eighteen (18) years violates this subsection B, such offense shall be punishable by a fine of fifty dollars ($50.00) for the first offense and/or community service, and one hundred dollars ($100.00) for a second or any subsequent offense and/or community service.
         b.   If a person under the age of ten (10) years old violates this subsection B, the parent, legal guardian, or other person having custody or control of such person shall be subject to a fine of fifty dollars ($50.00) for the first offense and/or community service, and one hundred dollars ($100.00) for a second or any subsequent offense and/or community service.
      3.   Detainment: A police officer may stop and detain a person whom the officer reasonably suspects to be violating this subsection B for not to exceed fifteen (15) minutes for the purpose of verifying the person's identity, age, school enrollment, and authority to be absent from school. The police officer shall immediately inform the person of the reason for the detention and that he or she will be released upon verification of authorization to be absent from school. The person shall not be removed from the scene of the investigatory detention unless he or she refuses to provide the officer with the necessary information.
      4.   Notice: A person violating this section shall, if practical, be taken to school authorities or a parent or legal guardian, and may be issued a notice to appear in a court of competent jurisdiction.
   C.   Parental/Guardian Responsibility: It shall be unlawful for a parent, legal guardian, or other person having custody or control of any person subject to this section to knowingly permit such person to violate this section. (Ord. 2007-O-03, 2-6-2007)
