2-3-5: APPLICATION FOR LICENSE:
Applications for licenses required by this chapter shall be made to the President of the Village and shall be in writing, signed by the applicant, if an individual, or by a duly authorized agent thereof, if a club or corporation, verified by oath or affidavit. In order to ensure timely initial issuance and/or renewal of a liquor license, a complete application for any liquor license shall be submitted to the Village Clerk by the applicant or his, her, or its agent(s): a) on or before March 15 of each year for a renewal for the next license year which begins on the following May 1st; and b) at least sixty (60) days prior to the proposed initial issuance date for any new liquor license. Any applicant who does not submit a fully completed application with all required supporting documents in compliance with the foregoing application deadline(s) shall be required to pay a ten percent (10%) license fee surcharge at the time of issuance of the liquor license(s) in question, but such license fee surcharge may be waived by the Village President, or his or her designee, upon good cause shown. Each application shall contain and/or be accompanied by the following information and statements:
   A.   The name, age and address of the applicant in the case of an individual; in the case of a partnership, each person entitled to share in the profits thereof; in the case of a limited liability company ("LLC"), each person entitled to share in the profits and each member and each manager thereof; and in the case of a corporation for profit or a club, the date of incorporation, the objects for which it was organized, the names and addresses of the officers, directors, and registered agent, and each person owning five percent (5%) or more of the stock of such corporation, and the name and address of such person(s); and in the case of a club, two (2) copies of a list of names and residences of its members and sufficient information to prove that it qualifies as a club pursuant to the provisions of the Illinois Liquor Control Act, as amended from time to time;
   B.   The citizenship of the applicant, his or her place of birth and, if a naturalized citizen, the time and place of his or her naturalization;
   C.   The character of business of the applicant; and in the case of a corporation or an LLC, the objects for which it was formed;
   D.   The length of time that such applicant has been in business of that character, or in the case of a corporation or an LLC, the date on which it was incorporated;
   E.   The location and description of the premises or place of business which is to be operated under such license and sufficient written evidence to establish the applicant's ownership of the premises proposed to be licensed or a signed lease between the applicant and the owner(s) of such premises;
   F.   A statement whether the applicant has made application for a similar license on premises other than described in this application in this Village or in any other jurisdiction and the disposition of such application;
   G.   A statement that the applicant has never been convicted of a felony and is not disqualified to receive a license by reason of any matter or thing contained in this chapter, laws of this State or this Code provision of this chapter or by reason of any provision of the Illinois Liquor Control Act, including but not limited to 235 Illinois Compiled Statutes 5/6-2;
   H.   Whether a previous license by any other jurisdiction has been revoked and the reasons therefor;
   I.   A statement that the applicant will not violate any of the laws of the State of Illinois, of the United States, or this Code in the conduct of his or her place of business;
   J.   Written evidence of liquor liability insurance coverage for the licensee and the licensed premises covering the entire license year, including, but not limited to, coverage for statutory dramshop claims in the minimum statutory amounts. (Ord. 2018-O-17, 8-7-2018)
