§ 10.99 GENERAL PENALTY.
   (A)   (1)   Except as provided in division (A)(2) below, any person convicted of violating a provision of this code in a Municipal Court of record may be fined an amount not to exceed $2,650.
      (2)   (a)   The limitation on municipal court fines set forth in division (A)(1) above shall be adjusted for inflation on January 1, 2014, and on January 1 of each year thereafter.
         (b)   As used in this division (A)(2), INFLATION means the annual percentage change in the United States Department of Labor, Bureau of Labor Statistics, consumer price index for Denver- Boulder, all items, all urban consumers or its successor index.
   (B)   Any person convicted of violating a provision of this code in a Municipal Court which is not of record may be fined an amount not to exceed $300.
   (C)   In fining a violator, the Municipal Judge shall not exceed the sentence or fine limitations established by ordinance.

   (D)   Surcharges.
      (1)   Surcharges for traffic code offenses. A surcharge equal to 40% of the fine imposed is hereby levied on each offence under the Model Traffic Code for Colorado Municipalities as adopted by the Town of La Jara, resulting in a conviction or a deferred judgment and sentence, which Municipal Court action is charged pursuant to Summons and Complaint issued by the La Jara Police Department. These surcharges shall be paid to the Clerk of the La Jara Municipal Court by the defendant, and such sums paid shall be added to the General Fund of the Town of La Jara.
      (2)   Surcharges for any and all other offenses. A surcharge equal to 40% of the fine imposed is hereby levied on each offence under with respect to a violation of any ordinance of the Town of La Jara providing for fines and penalties for the violation thereof, resulting in a conviction or a deferred judgment and sentence, which Municipal Court action is charged pursuant to Summons and Complaint issued by the La Jara Police Department. These surcharges shall be paid to the Clerk of the La Jara Municipal Court by the defendant, and such sums paid shall be added to the General Fund of the Town of La Jara.
