§ 71.04 JUNKED OR INOPERATIVE VEHICLES AND TRAILERS ON PRIVATE PROPERTY.
   (A)   Generally. The Board of Trustees of the town hereby declares that the keeping of any wrecked, partially wrecked, junked or inoperative trailer or vehicle, or part thereof, on any property within the incorporated limits of the town is a nuisance. It shall be unlawful for any person who is the owner of any such vehicle, trailer or parts, or any person who is in charge or in control of any property within the town, whether as owner, tenant, occupant, lessee or otherwise, to permit or allow any wrecked, partially wrecked, junked or inoperative vehicle, trailer or parts thereof to remain on such property. This section shall not apply with regard to a vehicle, trailer or parts in an enclosed building, in a storage place or depository maintained by the town for impounded vehicles, or completely concealed from public view by adequate fencing or landscaping.
   (B)   Investigation and notice of violation. The Chief of Police or his or her designee is hereby authorized to investigate any vehicle left at any place within the town and which reasonably appears to be in violation of division (A) above or lost, stolen or unclaimed. If after investigation there is probable cause for believing a violation of this chapter exists, the person making the investigation shall serve a notice of such violation upon the owner or occupant of the premises on which such vehicle is located, advising such person of the violation and ordering its removal within ten days from the date of the notice. Such notice may be served by personal delivery or by mailing the same by certified mail to the last known address of the owner or to the address of the premises, if occupied. No summons and complaint shall be issued for any violation of this chapter which occurs on private property until the expiration of ten days from the date of the notice of violation. In the event that the owner of the vehicle or the person in possession of the premises on which such vehicle is located cannot be found for a period of 14 days, then and in that event the summons and complaint alleging the violation of this section may be issued against the vehicle, describing the same by make, year, and model. The Chief of Police or his or her designees is hereby authorized to go on private property for the purpose of making an investigation for any violation of division (A) above for the purpose of determining ownership and condition of any vehicle reasonably appearing to be in violation of any of the provision of this chapter.
