(A) If the property owner believes that better drainage would be provided by another method other than a culvert, the property owner or authorized agent may petition the Director of Public Works for a variance of this subchapter’s culvert requirement.
(B) If the Director of Public Works, after inspecting the property and reviewing the method proposed by the property owner, concurs that the alternate method is equal to or better than the culvert method, then the Director of Public Works may grant a variance to the owner and inscribe on the permit the alternate method of drainage which will be allowed on the particular property. If the Director of Public Works determines that no culvert or other drainage method is necessary, he or she shall so indicate on the permit issued by the city to access city streets.
(C) If the Director of Public Works does not grant the variance, he or she shall state his or her grounds on the permit for the disapproval and what size of culvert will be required. The property owner may appeal the decision of the Director of Public Works by petitioning the Board of Adjustments and Appeals in writing for a hearing stating the grounds for the appeal. The Board of Adjustments and Appeals will then set a public hearing for the appeal within 30 days of the written appeal. If no appeal is taken within 30 days, the order shall be final and unappealable.
