(A) The Code Enforcement Board shall annually elect a Chair from among its members, who shall be the presiding officer and a full voting member of the Board. In the absence of the Chair, the remaining members of the Board shall select one of their number to preside in place of the Chair and exercise the powers of the Chair.
(B) Regular monthly meetings of the Code Enforcement Board shall be held monthly at a regularly scheduled place and time as set out in a published schedule. The Code Enforcement Board shall also be authorized to conduct special or emergency meetings by placing a notice on the front door and notifying the local newspaper in accordance with KRS 61.805 to 61.850. If there is no business to come before the Board nor any cases to be heard, the Chairperson may cancel the regularly scheduled monthly meeting by placing a notice on the front door of the meeting place and notifying the local newspaper.
(C) The presence of at least a majority of the Board’s entire membership shall constitute a quorum. The affirmative vote of a majority of the members constituting a quorum shall be necessary for any official action to be taken. Any member of the Code Enforcement Board who has any direct or indirect financial or personal interest in any matter to be decided shall disclose the nature of the interest and shall disqualify himself or herself from voting on the matter and shall not be counted for purposes of establishing a quorum.
(D) Minutes shall be kept for all proceedings of the Code Enforcement Board and the vote of each member on any issue decided by the Board shall be recorded in the minutes. Hearings shall be conducted as part of the meeting and each case shall appear as a separate item on the meeting agenda. All hearings shall be recorded by a court reporter or electronically by audiovisual means, which shall become part of the evidentiary record. Documents submitted as evidence shall be made part of the record.
(E) All meetings and hearings of the Code Enforcement Board shall be open to the public. Notwithstanding, the Board members may adjourn to an anteroom to deliberate amongst themselves prior to taking any action or deciding any issue that may come before it.
(F) The city shall provide clerical and administrative support for the proper conduct of the functions of the Code Enforcement Board.
