§ 35A.03 CODE ENFORCEMENT BOARD; POWERS; CLASSIFICATION OF VIOLATION AS CIVIL OFFENSE.
   (A)   The City of La Grange previously created a Code Enforcement Board with the power to issue remedial orders and impose civil fines as a method of enforcing city ordinances pursuant to the provisions of KRS 65.8801 to 65.8839. The existence and authority of the La Grange Code Enforcement Board shall be continuous throughout the repeal and replacement of Ord. 20-2014.
   (B)   Subject to the limitations set forth in division (C) of this section, the city may utilize the Code Enforcement Board to enforce any city ordinance or zoning regulation of property within its jurisdiction. Each ordinance to be enforced by the Code Enforcement Board shall provide that each violation of the ordinance shall constitute a civil offense. Any ordinance subject to a fine shall provide either:
      (1)   A specific civil fine or fines that may be imposed for each violation; or
      (2)   Separate civil fines stating either:
         (a)   A maximum civil fine that may be imposed if the citation is contested; or
         (b)   A specific civil fine of less than the maximum that shall be imposed if the citation is not contested.
   (C)   The city shall not classify the violation of any ordinance as a civil offense if the same conduct that is regulated by the ordinance would also constitute a criminal offense or a moving motor vehicle offense.
