§ 32.01  ECONOMIC DEVELOPMENT COMMISSION.
   (A)   All prior ordinances of the town as they conflict with the provisions of this chapter are hereby amended, repealed, or superseded by this section creating a Town Department of Economic Development, which department shall have all powers made available to a Department of Economic Development under I.C. 36-7-12-1 et seq., as same is now written, or as same may in the future be amended to provide for.

   (B)   The Town Council does hereby find that a need exists and there shall be created an Economic Development Department of the town for the purpose of creating or retaining opportunities for gainful employment, creating business opportunities, infrastructure and pollution controls to serve a public purpose and will be of benefit to the health or general welfare of the town.

   (C)   I.C. 36-7-12-4 establishes that once the fiscal body finds it necessary to finance economic development or pollution control facilities under this section and further necessary to establish a Department of Economic Development Commission as was previously done, that said department is to be controlled by a commission, the name of which shall be the town’s Economic Development Commission, which Commission and its members shall have all powers provided to it pursuant to I.C. 36-7-12-1 et seq., as same is now written, or may be in the future provided for.

   (D)   The Economic Development Department shall be administered as provided at I.C. 36-7-12-1 et seq. by the town’s Economic Development Commission which is hereby created, the membership of which shall be appointed according to state law and which shall exercise any and all powers provided by I.C. 36-7-12-1 et seq. in the furtherance of their duties consistent herewith.

   (E)   Upon passage and promulgation of the provisions of this section according to law, the Town Clerk-Treasurer shall promptly notify all executives and fiscal bodies required to make selections and nominations for membership of the Economic Development Commission, notifying said executive or fiscal body that they should respond to said request within 15 days of receiving such notice.

   (F)   The terms of membership and reappointments shall be governed by I.C. 36-7-12-9 et seq. as same shall from time to time be amended. The town’s Department of Economic Development and the town’s Economic Development Commission shall have all powers permitted by I.C. 36-7-12-4, including, but not in any way limiting, such powers provided at I.C. 36-7-12-17, I.C. 36-7-12-18, I.C. 36-7-12-18.5, I.C. 36-7-12-19, I.C. 36-7-12-20, I.C. 36-7-12-21, as well as any and all other powers which now exist, or may be added, to the state law as found at I.C. 36-7-12-1 et seq.
