§ 152.25  AUTHORITY TO ISSUE OR DENY PERMITS.
   It shall be the duty of the Council, upon the filing of a petition and approved bond, to issue to the petitioner a permit to make such excavation and do such work, and such permit shall describe the kind and location of the same; provided, however, the Town Council shall also have the authority to refuse to issue a permit for an excavation where the Council deems the work not to be in the best public interest or the contractor, by past performances, has indicated that he or she cannot perform the work in accordance with the specifications. The Town Council may, by resolution duly passed by a majority of such Council, authorize and empower their designated representative to issue any permits, all as provided for in this subchapter, and to determine the amount of the bond required.
