(A) In the town, there shall be no overnight parking between the hours of 2:00 a.m. and 5:00 a.m. in the parking lot located at 109-111 South Detroit Street, and the parking lot located directly southwest of the intersection of East Michigan Street and North Poplar Street. Any person violating the provisions of this division (A) commits a Class C infraction and shall, upon conviction thereof, be fined in an amount not to exceed $50, plus any and all attorneys’ fees and costs of collection.
(B) (1) It shall be unlawful for any semi-truck, heavy truck or heavy trailer to park on a town street unless said tractor/truck, trailer and/or power unit trailer combination is engaged in an unloading or loading situation, or in a properly zoned facility equipped for parking said vehicles.
(2) For purposes of this division (B), a HEAVY TRUCK, TRACTOR/TRUCK or HEAVY TRAILER is defined as a truck or tractor plated at 9,000 pounds or greater, a truck trailer combination plated at greater than 9,000 pounds, or a trailer separately plated at greater than 9,000 pounds.
(3) This division (B) shall not apply to any tractor/power unit, truck, trailer or combination thereof, plated or operated, by any federal, state, county, municipal agency or governmental unit.
(4) Violation of this division (B) shall be a Class A infraction, and any person deemed to have violated same should be responsible for the fine consistent with a Class A infraction, as well as any and all legal expenses incurred by the town in prosecuting or collecting same.
