151.07 OVERTIME AND COMPENSATORY TIME OFF.
   (a)   The Mayor shall determine the need to establish an overtime/compensatory time budget for all full time employees of the Village of LaGrange to meet unexpected operational needs pertaining to and providing for the health, safety and general welfare of the residents. This budget shall not be used in lieu of efficient scheduling of personnel to meet the operational needs and to provide Village services. Village Council shall appropriate funds for an overtime budget and compensatory time policy.
   (b)   The Village Police Chief and the Village Administrator shall (1) use all best efforts to assure efficient scheduling of personnel to minimize the use of overtime and/or compensatory time by department personnel; (2) provide to Village Council through the Mayor, an overtime/compensatory time budget request based upon projected department needs prior to the beginning of each fiscal year; (3) provide to Village Council through the Mayor, written quarterly reports indicating overtime and compensatory time used with cumulative totals.
   (c)   Employees other than persons engaged in law enforcement activities shall be entitled to overtime compensation at the rate of one and one-half times the employee's regular rate for each hour worked in excess of forty (40) hours in any given work period. Employees engaged in law enforcement activities shall be entitled to overtime compensation at the rate of one and one-half times the employee's regular rate for each hour worked in excess of eighty (80) during any given work period. Employees must have prior approval by his or her supervisor before work for any hours over the prescribed work period is performed. The total number of overtime hours worked by each employee shall be ascertained and certified by the office of the Fiscal Officer and shall be paid to the employee at the time such employee is paid for the work period during which such overtime is earned.
   (d)   Employees other than persons engaged in law enforcement activities may be called in to work to evaluate or complete a task after the normal work hours. If the task is completed in less than one hour, a minimum time of one hour will be paid to the employee.
   (e)   In lieu of overtime, a full time employee may receive compensatory time off at a rate not less than one and one-half (1 ½) hours for each hour for which this section requires overtime compensation. In the event accrued compensatory time off has not been used by December 31 of any year in which such compensatory time off has accrued, then the Village may elect to compensate the employee entitled to such compensatory time off based upon said employee's regular rate earned at the time such payment is made.
   (f)   Compensatory time and compensatory time off shall mean hours during which an employee is not working which are not counted as hours worked during the applicable work period for purposes of calculating overtime compensation and for which the employee is compensated at the employee's regular rate.
   (g)   An employee who has requested the use of compensatory time shall be permitted by the employer to use such time within a reasonable period after making the request and the use of such time does not unduly disrupt the operations of the Village. Utilized compensatory time shall be deducted from an employee's accumulated compensatory time in increments of not less than one-quarter (1/4) hour. An employee may accrue no more than twenty-four (24) hours of compensatory time.
   (h)   An employee who has accrued compensatory time off shall upon termination of employment be paid for the unused compensatory time at the average regular rate received by the employee in the last three (3) years of employment, or the final regular rate of pay, whichever is higher.
   (i)   Paid sick leave, bereavement leaves and vacation time does not count as hours worked for the accumulation of the forty (40) hour week for overtime calculation.
