1341.04 DEFINITIONS.
   As used in this Code, unless the context requires a different meaning:
   (a)   "Accessory structure" means a structure on the same lot with, and of a nature customarily incidental and subordinate to, the principal structure.
   (b)    "Building" means a structure which is permanently affixed to the land, having one or more floors and a roof, being bounded either by open spaces or walls and which is used as a shelter or enclosure for persons, animals and/or property. This term shall be used synonymously with "structure" unless otherwise noted and shall be construed as if followed by the words "or part or parts thereof."
   (c)    "Building Inspector/Official" means the person designated by the Council to enforce the provisions of this Code pursuant to Part 13 of these Codified Ordinances.
   (d)   "Deterioration" means the condition or appearance of a building or part thereof, characterized by holes, breaks, rot, crumbling, cracking, peeling, rusting or other evidence of physical decay, neglect or lack of maintenance.
   (e)    "Developed lot" means a subdivided land mass where a lot is part of a subdivision recorded in the office of the County Recorder, or a lot or parcel described by metes and bounds, the description of which has been so recorded. The parcel of land occupied or to be occupied by a principal structure or group of structures having not less than the minimum required frontage upon an improved public street, either shown and identified by a lot number of a plat of record or considered as a unit of property.
   (f)    "Developed street" means a street with lots comprised of properties dedicated or intended for public and private road, street, alley, highway and freeway or roadway purposes or to public easements for the extension and maintenance of public sewer, water storm drainage or other public facilities and improvements.
   (g)    "Dwelling" means a structure designed for occupation as a residence for one or more families, each living independently in a separate dwelling unit.
   (h)    "Dwelling unit" means space within a dwelling with rooms providing complete living facilities for one family, including equipment for cooking or provision for the same, and rooms for living, sleeping, bathing and toilet facilities and eating; all used by one family and having its own means of entrance which can be distinguished from other dwellings
   (i)    "Exposed to public view" means readily capable of being viewed by the public, or any member thereof, without special aids, from a sidewalk, street, alleyway, open air parking lot or the area of any adjoining or neighboring premises.
   (j)   "Exterior of the premises" means those portions of a building which are exposed to public view and the open space of any premises outside of any building erected thereon.
   (k)    "Fire hazard" means any thing or act which increases or may cause an increase in the hazard of fire to a greater degree than that customarily recognized as normal by persons in the public service of preventing, suppressing or extinguishing fire, or which may obstruct, delay or hinder, or may become the cause of obstruction, delay or hindrance to, the prevention, suppression or extinguishment of fire.
   (l)   "Front yard," is an open unoccupied space on the same lot with a main building extending the full width of the lot from the right-of-way and the front building line. Corner lots, includes two front yard setbacks required by these Codified Ordinances for any lot located on any corner or abutting on two or more thoroughfares.
   (m)    "Garbage" means putrescible animal and vegetable waste resulting from the handling, preparation, cooking or consumption of food, or other worthless, useless or unwanted matter
   (n)    "Immediate neighborhood" means an area separated by no appreciable space and specially denoting a limited number of properties in a very close space relationship to each other, such as properties located within the same block.
   (o)    "Infestation" means the presence of insects, mice, rats, vermin or other pests on the premises that constitute a health hazard.
   (p)    "Nuisance" means and includes:
      (1)   Any public nuisance known in law or as provided for by the statutes of the State or the ordinances of the Village of LaGrange;
      (2)   Conditions dangerous to human life or detrimental to the health of persons on or near the premises where such conditions exist;
      (3)   Unsanitary conditions; and
      (4)   Fire hazards.
      (5)   Unsafe Buildings
   (q)   "Operator" means any person who has charge, care or control of a building, structure, dwelling or premises, or part thereof, whether with or without the knowledge and consent of the owner.
   (r)   "Owner" means the owner or owners of the premises, including the holder of the title thereto subject to a contract of purchase, a trustee, a vendee in possession, a mortgagee or receiver in possession, a lessee or joint lessees of the whole thereof, a tenant, an agent, or any other person, firm, corporation or fiduciary directly in control of the premises.
   (s)    "Premises" means a lot, plat or parcel of land, including all buildings and structures thereon.
   (t)    "Putrescible" means having the ability to decompose or rot.
   (u)    "Refuse" means all putrescible and non-putrescible solid wastes (except body wastes), including, but not limited to, garbage, rubbish, ashes, street cleaning and dead animals.
   (v)    "Rooming unit" means any room or group of rooms forming a single habitable unit other than a dwelling unit, which is rented or available for rent for sleeping purposes, with or without cooking facilities.
   (w)   "Rubbish" means non-putrescible solid wastes consisting of both combustible and non-combustible solid wastes, such as paper, wrappings, tin cans, yard wastes, wood, glass, crockery and similar materials.
   (x)    "Stored" means left on premises and reserved for future use as opposed to present use.
   (y)    "Weathering" means deterioration, decay or damage caused by exposure to the elements.
   (z)    "Yard waste" means grass, leaves, branches, brush, organic natural matter and organic vegetative matter, but does not include animal waste or food waste, including meat and dairy products.
   (aa)    "Zoning Code" means the Planning and Zoning Code of the Village of LaGrange, being Part Eleven of these Codified Ordinances.
