§ 92.02 WOOD BURNING STOVES.
   (A)   Outside wood burning stoves prohibited. The installation or maintenance or operation of outside wood burning stoves in the city is prohibited.
   (B)   Outside wood burning stoves defined. An outside wood burning stove is defined as a freestanding outside device designed to burn wood, wood pellets or other combustible material, typically maintained in a small shed-like structure containing a firebox to heat water in a water jacket which surrounds the firebox, with a short smoke stack.
   (C)   Preexisting outside wood burning stoves. Outside wood burning stoves existing in the city prior to the enactment of this section may continue as a nonconforming use but as such are subject to the prohibition within the city of the maintenance of nuisance(s) which their operation may constitute.
   (D)   Violations of the provisions of this section may be charged as petty misdemeanors or misdemeanors and upon conviction thereof punishable in accordance with the laws of the State of Minnesota. Each day a violation exists constitutes a separate offense.
