§ 94.23 SNOW REMOVAL FROM SIDEWALKS.
   (A)   Every owner or occupant of any real property fronting upon or adjoining any street upon the side thereof where there is a cement sidewalk constructed by the direction of the Council, shall clean such sidewalk as far as the same extends in front of or opposite such premises of all snow to the whole width thereof within 24 hours after such snow shall cease to fall.
   (B)   Any owner or occupant of any real property who shall violate any provisions of this section by failing to remove such snow as herein provided, shall be deemed guilty of a misdemeanor according to Minnesota Statutes. In any case where any such cement sidewalk in front of or adjoining any such lot or parcel of ground within the city shall remain covered in any part with snow for 24 hours after such snow shall have fallen and shall have ceased to fall, it shall be the duty of the City Building Official to immediately, after the expiration of such 24 hours, cause such snow to be removed from the full width of such sidewalk and to report the expense thereof to the City Council at their next regular meeting thereafter with a description of the lot or parcel of land in front of or adjoining which such snow was removed and the City Council shall cause such expense to be audited and paid out of the general city fund, and shall direct the City Building Official to charge such expense to the lot or parcel of lot fronting such street in front of which such expense shall have been incurred and the amount of such expense shall, on or before June 1 of each year, be, by a resolution of the City Council, assessed and levied against each such lot or parcel of ground as a special tax against the same. On October 10, next following, if any assessments so made against any lot or parcel of ground be not previously paid to the City Treasurer, the City Clerk shall certify the same to the County Auditor, who shall extend all such unpaid amounts against the land assessed and the same shall be enforced, collected and paid to the City Treasurer.
