§ 95.05 SAFETY FENCE REQUIRED.
   (A)   A safety fence, so as to inhibit entry, at least five feet in height, shall completely enclose the pool. All openings or points of entry into the pool area, including those through a dwelling or other building which forms a part of the enclosure in lieu of fence, shall be equipped with lockable gates or doors. All gates in safety fences shall have a latch which shall be so constructed and so placed as to be at least 48 inches above ground level. Any opening between the bottom of the fence and the ground level shall not exceed four inches.
   (B)   Gates shall be self-latching when closed and lockable and the fence designed so as to inhibit entry except through gates or doors.
   (C)   The wall of any pool constructed above ground level, regardless of the height thereof, shall not qualify as a safety fence.
   (D)   The requirement for fencing shall be met to the extent and as to those parts of the perimeter of the pool located adjacent to a private residence or building where entry at this location can be attained only through such residence or building.
