§ 50.04 CITY COMPOST SITE REGULATION.
   (A)   Any violation of the policy and procedure with reference to the regulations of the city landfill set forth in division (B) of this section is deemed a trespass and subject to prosecution and penalties consistent with the laws of the state for misdemeanors.
   (B)   With regard to the control of the “city compost site,” the following policy and procedure shall apply:
      (1)   The old city compost site is being operated as a site for disposal of certain biodegradable items which will not, in the judgment of the Minnesota Department of Natural Resources and Minnesota Pollution Control Agency, pollute the surrounding wetlands.
      (2)   Only the following items, along with other items deemed acceptable by the City Administrator, may be placed at the site: leaves, brush, grass and solid fill materials such as rock, sand, cement and dirt.
      (3)   Access to the site shall be as established by the City Council.
      (4)   Access to the site may be restricted from time to time for maintenance procedures such as burning and clearing by the city maintenance department.
      (5)   Control over the site is the responsibility of the City Administrator's office and the Police Department.
   (C)   A violation of this policy is, upon conviction, punishable in the manner determined by the laws of the state for misdemeanor offenses, and the enforcement of this policy is the responsibility of the City Administrator and the Chief of Police.
