(A) Required. All locations in the city where garbage bags are distributed and made available to residents in connection with and a part of the implementation of the solid waste pickup and disposal program in the city shall, from and after the effective date of this section and code provisions embodying the provisions of this section, be required to be licensed by the city.
(B) Licenses issued by City Clerk. Licenses for the distribution of garbage bags for use in the city shall be obtained at the office of the City Clerk, City Hall, La Crescent, MN 55947, at which office applicants for licenses may obtain the necessary application from which shall be completed and signed by or on behalf of the potential licensee prerequisite to the issuance of a license.
(C) City Council to establish fee schedule. At the outset, no fee shall be charged for the issuance of licenses for garbage bag distribution sites, but the City Council may, from time to time, by resolution duly enacted, establish a fee schedule therefor.
(D) Licensees to be bonded. In connection with the issuance of each license and preliminary to the licensee commencing the condition of services entailed in the distribution of garbage bags to residents and other sources of solid waste appropriate for garbage bags under the city solid waste pickup and disposal program, the licensee shall be bonded in the minimum penal sum of $5,000 and each license applicant shall provide the necessary information and execute whatever application forms are necessary in connection with the bonding process.
