§ 92.18 EXEMPTIONS.
   (A)   Generally. Open burning of the types, and subject to the conditions as stated in this subchapter, shall be exempt from the prohibition of §92.16 and §92.17 to the extent that exemptions are consistent with the rules and regulations promulgated by the DNR.
   (B)   Exemptions:
      (1)   Fires set for recreational, ceremonial, food preparation or social purposes are permitted; provided, only wood, charcoal, coal or gas is burned and the fire is contained in an approved container or containment.
      (2)   Fires under managed supervision, for which a written burning permit has first been obtained from the Fire Chief (or in the absence of the Fire Chief, the Fire Marshal) of the Volunteer Fire Department, but limited to the following:
         (a)   Fires purposely set for the instruction and training of public and industrial firefighting personnel.
         (b)   Fires set for the elimination of a fire hazard which cannot be abated by any other practicable means.
         (c)   Ground thawing for utility repair and construction in the maintenance of street, road and highway right-of-way.
         (d)   Activities in accordance with accepted forest or game management, and in accepted agricultural land management practices.
         (e)   The disposal of diseased shade trees.
         (f)   Bonfires such as homecoming events and other school or community celebration, or fires which are an integral part of religious or cultural ceremony.
