(A) Purpose. The purpose of this section is to enact special procedures for establishing physically handicapped parking in the city pursuant to which owners of property, private as well as public, may, at locations on public thoroughfares adjacent to their property, designate parking for the physically handicapped which, if consistent with guidelines hereinafter provided, shall, upon resolution duly passed and enacted by the City Council, become official physically handicapped parking.
(B) Physically handicapped parking guidelines.
(1) Owners of properties situated in the city who are desirous of establishing physically handicapped parking, shall submit application therefor to the Chief of Police of the city, such application to contain the precise diagrammatic presentation of the requested physically handicapped parking, show its location with reference to the public thoroughfare upon which it abuts, the dimensions thereof and a disclosure as to the insignia or signs to be erected at the location, identifying such parking.
(2) If, in the judgment of the Chief of Police, all applications to establish physically handicapped parking involves areas where access to firefighting vehicles and equipment and other emergency vehicles may be involved, the Chief of Police may refer the application to the Fire Chief of the Fire Department for comment and recommendation.
(C) Official establishment. Upon receipt by the City Council of the comment and recommendation of the Chief of Police, and in cases where permit applications are referred to the Fire Chief, the comment and recommendation of the Fire Chief, the City Council may, by resolution, establish physically handicapped parking at any appropriate location within public rights-of-way within the city which shall, if the enabling resolution of the City Council specifies, require indicated approved insignia and signs erected at the expense of the applicant.
(D) Code provision. All physically handicapped parking established pursuant to this section shall, upon adoption of the enabling resolution, the erection of appropriate signs, be entered into the parking schedules of Chapter 73 indicating the date and number of the City Council resolution adopting such parking regulations together with a concise description and precise location thereof. The City Council resolution shall make specific reference to the parking schedules of Chapter 73 and shall provide the number citation thereto.
(E) Penalties. The penalties for violation of all physically handicapped parking established pursuant to this section shall be punishable, some as petty misdemeanors and some as misdemeanors, depending upon the circumstances set forth in M.S. § 169.346, as amended, which statutory regulation is incorporated herein by this reference as if set out in full herein.
